Acceptance and changes
By visiting, linking, or continuing to use this site after we post a change, you agree to the then-current terms. We may update the terms to reflect new features, legal requirements, or clearer language. When a change is material, we will take reasonable steps to draw attention to it, such as a short notice on the home page for a limited time, in addition to updating the text here. If you do not agree, you should stop using the site. Your continued use after the effective date of a change is treated as acceptance of the revised terms for future use. Prior conduct is judged under the terms that applied at the time.
Eligibility
The site is aimed at adults acting in a business capacity. If you are under the age of majority in your jurisdiction, you may use the site only with involvement of a parent, guardian, or employer as appropriate. We reserve the right to refuse or end access when we reasonably believe a line has been crossed, after notice when practical.
Content and accuracy
Page copy is provided for information about how we work and what you might expect in a business conversation. It can become outdated. Case studies and examples, if we publish any, are illustrative, not a promise that your organization will have the same experience, because your building, schedule, and suppliers differ. The site does not create a client relationship by itself, and no reply to a form message is legal, medical, or other regulated professional advice unless a separate engagement letter says so.
Intellectual property
Unless otherwise stated, the trade name Ghomryonshod, the site design, text, light illustrations, and selection and arrangement of materials are protected by copyright, trademark, and unfair competition laws, or are used under license. You receive no ownership rights by reading the site. A limited, revocable, non-sublicensable license allows you to view and store cache copies the way a normal browser does, and to quote short excerpts with attribution. Any broader use, including mirroring, commercial republication, or making derivative works, requires our written consent except where a statutory exception such as fair use or fair dealing clearly applies in your case and you are comfortable relying on that without a separate license from us.
Third-party links and tools
We may link to maps, product pages, or standards bodies for your convenience. Those sites are not under our control, and we are not responsible for their availability, privacy practices, or content. Your use of third-party resources is a matter between you and the third party. If a tool embedded on a page (such as a font delivery network) loads resources from a third party, that party’s terms may also apply; we try to use reputable providers, but you should read their terms if you rely on a specific integration.
Disclaimer of warranties
The site and all materials, links, and services accessed through the site are provided on an “as is” and “as available” basis, without any warranty of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by applicable law. We do not warrant that the site will be uninterrupted, error free, or free of harmful code, although we use reasonable care. You download or use content at your own discretion and risk.
Limitation of liability
To the fullest extent permitted by law, in no event will Ghomryonshod, its officers, staff, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profit, data, goodwill, or business interruption, even if we have been advised of the possibility of such damages, arising from or related to the site, except where a jurisdiction does not allow such a limitation, in which case it applies to the maximum extent allowed. Our aggregate liability for all claims related to the site in any rolling twelve month period, whether in contract, tort, or otherwise, is limited to the greater of (a) one hundred US dollars, or (b) the amount you actually paid to us in fees for the specific service giving rise to the claim in that period, and if (b) is zero because no service created the claim, then to (a) alone, unless a higher amount is required by a law you cannot contract around. The existence of more than one claim will not expand this cap. This section reflects a fair allocation of risk between a public information site and its visitors, given that the site is offered without a usage fee in most cases.
Indemnity
You will defend, indemnify, and hold harmless Ghomryonshod and its personnel from and against any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the site, your violation of these terms, or your violation of a third party’s rights, except to the extent a claim is caused by our willful misconduct or gross negligence as found by a final court order. We will give you notice of a claim for which you must defend us when we can do so without prejudicing a legal position, and you may not settle a claim in our name without our written consent. If you and we disagree about a settlement that includes an admission, we are not required to accept it; we can instead continue defense at your expense, subject to the liability cap in the previous section, where that cap is determined to apply.
Governing law and disputes
These terms, and any dispute that arises out of or relates to the site, are governed by the laws of the State of New York, without regard to conflict of law rules that would apply another state’s law. The federal and state courts located in New York County, New York, USA, have exclusive jurisdiction, and you submit to the personal jurisdiction of those courts, except that where a consumer or employee protection law in your home jurisdiction gives you a right to a different forum, that right remains. If a provision of these terms is held unenforceable, the remainder stays in effect, and a court may reform the stricken part to match the original intent to the maximum enforceable degree.
Online advertising and landing pages
When we run online advertising, including search or display, we aim for the landing experience to match what the ad described in substance: the same business identity, the same physical and electronic contact details, and the same offer categories we describe in writing elsewhere on the site. We do not use advertising to show one business and deliver another. If you reached us from an ad, you are reading the same public pages a visitor from organic search or a direct bookmark would see, unless a separate campaign URL is clearly labeled in the ad itself. Advertising does not create a different warranty or a guarantee of business or personal results. Services you purchase in writing are governed by the order you sign. General site information remains educational and is not a substitute for advice from a licensed health professional when that is appropriate in your case.
General provisions
These terms, together with the policies linked here, are the entire agreement for site use to the extent they address the same subject, superseding prior website-only statements unless we expressly preserve them. We may assign our rights in connection with a merger or sale of business; you may not assign without our consent, except that a corporate reorganization of your employer with notice to us is acceptable. No delay in enforcing a right is a waiver, except a signed waiver. Headings are for reading ease only.
